Clarification in Regard to Dept. of Education Cuts (3.24.25)

Dear ELCA School and Learning Center Leaders, 

In light of recent discussions regarding potential changes to the U.S. Department of Education, I have provided insights from the Council for American Private Education in an attempt to clarify what these developments might mean for our schools.  

There has been considerable speculation about the future of the Department of Education. CAPE leadership has emphasized several important points: 

Congressional Action Required: Any fundamental restructuring of federal education programs—whether moving them to other agencies or converting them to state block grants—would require congressional legislation, not merely executive orders. 

Legislative Hurdles: Such legislation would face significant challenges, including the likelihood of a Senate filibuster requiring a 60-vote threshold. 

Programs Protected by Statutes: The federal education programs that our schools rely on are established by law and remain in force until changed by Congress. 

Current Administrative Position: The Administration has indicated these programs will continue to operate normally despite potential administrative changes. 

Through CAPE, ELEA’s federal advocacy work is primarily carried out through our membership in the Council for American Private Education (CAPE). CAPE represents the collective interests of private schools, including Lutheran schools, in federal education policy matters. Through this partnership, CAPE is actively lobbying Congress and the Department of Education regarding our shared concerns. They ensure private schools have a unified voice in these discussions.  The ELEA contributes to and benefits from CAPE’s expertise in navigating federal education policy. 

We recommend that ELEA schools: 

  • Continue operating as usual with regard to federal programs and funding 
  • Complete any pending applications or reporting requirements on schedule 
  • Maintain records of program participation and impact 

While much remains uncertain, ELEA, working through CAPE, is committed to representing Lutheran schools throughout this process. Should concrete legislative proposals emerge that would substantially alter education funding or program administration, we will provide further guidance.
